UK Сouple Wins IVF Funding In Court

A PORTSMOUTH couple have won a rare IVF funding victory.

Donna, 36, and Dean Marshall, 41, had been trying for a baby for three years and were unsuccessful.

The couple were refused funding from NHS Portsmouth as they did not meet the criteria of being ‘childless’, because Mr Marshall had a child from a previous relationship, and Mrs Marshall was slightly over the age limit of 30 to 34.

The pair were represented by fertility lawyer of Porter Dodson Solicitors, who won the case for them to get IVF.

Donna said: ‘We were devastated when we were told we would not be eligible for IVF funding on the NHS.

‘We were in a state of shock when we found out we had won our appeal.’

NHS Portsmouth said it cannot comment on individual cases, but that it follows guidelines which state IVF treatment is usually funded according to strict criteria.

This is based on a range of evidence, including age and whether the treatment is likely to succeed.
